Key Responsibilities:

Responsible for all the legal and administrative aspects relating to the activities of the Company,  in charge of the strategy (general orientations) of the legal department.

• Work to achieve operational objectives in the area of work with a direct impact on the results of the department
• Provide a measurable contribution to the new processes or standards in the operational plans that will have some impact on the achievement of overall function results
• Sets goals for own area of work to meet project and mission objectives or goals
• Resolve escalations in accordance with the procedures and resolutions defined in the matter by the group and by the OpCo
• Design and implement operational changes and provide an associated user impact assessment
• Improve productivity and quality by recommending practical initiatives
• Provide information to the line manager (as needed) regarding progress made within the department, in accordance with measures set by the company
• Responsible for the Legal and regulatory reports and declarations

Judicial direction:
• Design, define and implement the legal strategy (global orientations)
• Daily supervision of the tasks entrusted to the legal advisor
• Provide legal opinions for the attention of the CEO, when needed
• Validate contracts and draw up sensitive contracts for the Company
• Oversee the relations with lawyers and the daily follow-up of all cases and disputes before the courts and tribunals

Company Secretary:
• Take an active part in all meetings of professional organizations
• Build and maintain relations with public administrations (eg: Ministries, public services relating to the Company’s sector of activity)
• Design and coordinate activities relating to the Social Responsibility of the Company (eg: CSR)
• Ensure the updating of strategic information of the Company (KYC)

Supervision of the Site Acquisition Management:
• Supervise the acquisition of sites: approval of the lease contract, control of the acquisition report, verification of the authorizations required by law
• Supervise legal compliance with the environment: Ensure the proper execution of Environmental Impact Studies, Monitoring the execution of ESMPs and PMCES
• Control donor payments (payment deadline and quality of beneficiaries)
• Supervise complaints from donors and residents and ensure that a follow-up is made to requests from donors

Support for Administration and Human Resources:
• Monitoring and advice on contracts managed directly by Human Resources
• Advice on the design and execution of employment contracts
• Permanent member of the Disciplinary Commission

Support to the Tax and Parafiscal Service:
• Take an active part in the management of pre-litigation and litigation files
• Ensure compliance with legal provisions relating to the recovery of rights owed to the State

Project management:
• Design and / or Analyze Projects (product definition, objectives, project members)
• Supervise the implementation of Projects (monitoring, evaluation and control of reports)

Legal and regulatory reports and declarations:
• Ensure the required update in Site Share
• Ensure the control and transmission of reports
• Updating of the Legal Register and monitoring of actions relating to regulatory requirements

Leadership and personnel management
• The ability to work in a team
• Responsible for self-learning and development
• Ensure a work coherent with their functional area
• Responsible for respecting and prioritizing their own objectives / deadlines
• Provide his supervisor with information on the achievements of the department as well as on individual and team issues
• Contribute to team meetings and contribute in specialist / technical areas as needed
• Review and report functional performance to the manager

 

Required Qualifications:

• Lawyer, holder of a Law Degree (MBA degree would be an asset, BAC + 5).
• 5-7 years of professional experience, and at least 5 years in the legal field
• Training and expertise in OHADA law would be an asset
• 3 – 5 years of of experience in the Telecom industry
• Knowledge of Senegal’s legal, judicial and administrative environment
• Fluent English and French
